34 and 35, T10S, R98W and Section 1 and 2, T11S, R98W. Portions of this activity are <br />located above mined out and active areas of the Roadside South Portals. A cell tower was <br />constructed in 2000 on property owned by Rudy Fontanari located in Section 34, T10S, <br />R98W. In 2004 a house was constructed on surface land owned by Sharon Sample and in <br />2007 a house and shop building were constructed on surface land owned by Mr. Edmonds. <br />These properties are located in Section 1, T11S, R98W and are directly over mined out <br />portions of the Roadside South Portals where no further mining will occur. The location of <br />these buildings and ditches are shown on Exhibit 46. Other buildings and structures which <br />exist within the permit and adjacent area are located on Exhibits 6B, 7C and 86 through <br />11 B. <br />The former Colorado Ute Electric Association (currently owned by Tri-state Generation and <br />Transmission Association, Public Service of Colorado (PSCO), and Western Area Power <br />Administration installed a 345KV transmission line across portions of the permit area in <br />1985. BLM subordinated their right-of-way agreement #C-29423 to Powderhom's Federal <br />Coal Lease No. C-029889. See Exhibit 46 for the location of the line and steel structures. <br />Exhibit 20-5 was a worst case subsidence study of the affect of mining on the structures. <br />Exhibit 20-6 is a copy of BLM's notice to proceed with construction across the coal lease <br />and contains wording related to the subordination agreement. Exhibit 20-7 includes an <br />anticipated impact statement from the PSCO. Public Service Company upgraded their <br />transmission line up Coal Creek in 1985. BLM subordinated their right-of-way to <br />Powderhorn's Federal Coal Lease C-01538. Appendix 20-7 is a copy of an agreement <br />between PSCO and Powderhorn. In this agreement, PSCO agreed to move their line if <br />necessary to allow Powderhorn to mine the underlying coal and Powderhorn agreed to <br />notify them six months prior to mining under the line. <br />There are no other structures or farming above past and projected mining areas of the <br />Roadside North Portals mining area. Limited grazing is done above the Roadside North <br />and South Portal areas. <br />(b) Current mine plans do not involve additional mining below the Ute Water Conservancy <br />District facilities or pipelines.
