AFFECTED ENVIRONMENT / ENVIItONMENTAL CONSEQUENCES /MITIGATION <br />MEASURES: <br />CRITICAL ELEMENTS <br />AIIt QUALITY <br />Affected Environment: There aze no designated Class I air sheds in the area; the nearest Class I <br />azeas aze 50+ air miles away, with the Flattops and Mazoon Bells wilderness azeas and Black <br />Canyon NP being the closest. The EPA general conformity rule requires a formal conformity <br />determination document for federally sponsored or funded actions in nonattainment areas, or in <br />certain designated maintenance azeas when the total direct and indirect net emissions of <br />nonattainment pollutants (or their precursors) exceed specified de minimis levels. Since the <br />project azea is not within a nonattainment azea, Clean Air Act conformity does not apply. <br />Environmental Consequences/Mitigation: Access road construction would cause some negative, <br />direct impacts to air quality due to fugitive dust resulting from surface disturbance. This impact <br />would be minor and short term, and insignificant. <br />AREAS OF CRITICAL ENVIRONMENTAL CONCERN <br />Affected Environment: There will be no ACECs affected by this proposal.' <br />Environmental Consequences/Mitigation: None <br />CULTURAL RESOURCES <br />Affected Environment: A records seazch of the general project azea, and a field inventory of the <br />Area of Potential Effect, as defined in the National Historic Preservation Act (NHPA), was <br />conducted by Grand River Institute, a Colorado BLM permitted cultural resource contracting <br />firm (reference GJFO CRIB 1106-11). The project was reviewed by the GJFO Archaeologist <br />and is in compliance with the NHPA, the Colorado State Protocol Agreement, and other federal <br />law, regulation, policy, and guidelines regarding cultural resources. Seven prehistoric sites and <br />two historic sites were recorded. Of those sites four sites were evaluated as eligible for <br />nomination to the National Register of Historic Places, SGF 3878, SGF3870, SGF3880, <br />and5ME15398. These sites will be avoided by incorporating the following mitigation. <br />Environmental Consequences/Mitigation: A Colorado BLM permitted archeological consultant <br />must be present to monitor arid ensure the avoidance of SGF3880 during any work associated <br />with the overland travel that is proposed to access drill sites #6 and #8. Following overland use <br />from the end of the existing route hand tools should be used to obscure the vehicle tracks to <br />avoid the public from extending the existing route and thereby creating a new 2-track mad which <br />would impact the site. Any changes in drill location or access routes will require review by the <br />azchaeologist prior to authorization. If newly discovered cultural resources are identified during <br />any of the project implementation, work in that area should stop and the BLM Authorized <br />Officer should be notified immediately (36 CFR 800.13). <br />ENVIRONMENTAL JUSTICE <br />Affected Environment: The requirements for environmental justice review were established by <br />executive Order 12898 (February 11, 1994). That order declazed that each Federal agency is to <br />identify "disproportionately high and adverse human health or environment effects of its <br />programs, policies, and activities on minority populations and low income populations." <br />According to Census 2000, the only minority population of note in the impact area is the <br />
