c. This permit does not grant exclusive use of the land <br /> described, and the permit area shall be available for other <br /> surface uses, including lives cock qra=ing, where compatible <br />with operations conducted ~y the permittee. This permit is <br />( subject to all leases nov in effect on said land, and the <br /> permittee is to cooperate with, ant not :o interfere with. <br /> nor prevent the operations of the lessees. In all cases <br /> this permit is subject to any rights-of-way herecotore <br />~~ granted and now in effect. Coal lessee shall not be <br />. ~ responsible for any damage; to wells if mining should <br />.~. ~ occur. This permit shall be cancelled upor. written notice <br /> to the permittee if coal lessee should reeuire these lands <br />. ~ foz its mining operations relative to a lease on this land. <br /> d. The petmittee is tc provide d[ainage and erosion contro'_ <br /> structures, fences, gates, cattlequards, or any c[her <br />. ~ facilities necessary to protect state land. <br /> e. Drill poles, excavations, and improvements shall be <br />~~ -- ~ ~ maintained in a safe condition to prevent injury tc <br /> persons, livestock and wildlife. <br />f. All operations of [he permittee shall be conducted in a <br />workmanlike and reasonable manner, and all necessary <br />precautions shall be taken to avoid any damage to the state <br />land or the property of the lessee. Any damage done to the <br />~ state's property, native grass or timber, or stale-owned <br />improvements, shall be paid for to the state. Da mage to <br />- private property including fences, crops, irriga [ion <br />structures. wells, livestock and privately-owned <br />improvements, shall be paid fo[ to the owner thereof. <br />C• q. To the extent authorized by law, the permittee shall <br />indemnify, save and hold harmless the Board of Land <br />Commissioners, its employees and agents, against any and <br />all claims, damages, liability and court awards including <br />costs, expenses and attorney fees incurred as a result of <br />any act or omission Dy the permittee, or its employees, <br />agents, subcontractors or assignees pursuant to the terms <br />of this permit. <br />h. This permit does not grant the use of water from said <br />- premises, either from flowing streams or f[om wells unless <br />specifically authorized by the Board in writing. Normal <br />~~ sampling of the monitoring well shall not be considered as <br />a violation of this condition, however any permitting <br />required by the laws of the state shall be filed in the <br />name of the state though the Board. <br />i. No refuse, waste oc litter of any kind shall be left on the <br />land. The permittee shall comply with all federal and <br />state laws, regulations and standards relating Co air, <br />. ~ water, land and noise pollution. <br />• <br />- 2 - <br />
