EXHIBIT N- Source of Leeal Rieht to Enter (Rute 6.4. I4 <br />In this item you state that we must provide the source of the right to emer and initiate a <br />mining operation on the affected land. This rule 6.4.14 refers back to rule 6.3.7, which <br />state that " Provide a description ofthe basis for legal right of entry to the site and to <br />conduct mining and reclamation, for Owners of record described in Rule 1.6.2(1}(e)(i). <br />This may be a copy of access lease, deed, abstract of title, or a current tax receipt, a <br />signed statement by the Landowner and acknowledged by a Notary Public stating that <br />the Operator/Applicant has right to enter and mine is also acceptable. <br />In the permit application submittal package there is a document, which is labeled as <br />LEASE AGREEMENT WITH OPTION TO BUY MATERIAL. In this Lease <br />Agreement signed by the Landowners and the Operator/Applicant it states on the first <br />page, sixth pazagraph "the Company shall have the right of ingress and egress to and <br />from the subject premises and to erect any temporary structures, such as screening, <br />crushing, and/or asphalt or concrete plants, to stockpile material in an area of sufficient <br />size; and to employ any reasonable methods for the removal of said material. The <br />Company shall also have the right ofingress and egress for the purposes ofreclamation. <br />This only part ofthe lease which is a binding and legal contract, therefore I believe we <br />have meet the conditions required as stated in Rule 6.4.14.. Additionally with the lease <br />a Wan•anty Deed showing ownership has been included as well as an Colorado <br />Department of Transportation Access Peanit Number 206080 granted to the Landowner <br />Randall and Joyce Howell and the Operator/Applicant Frank Leone. If you need further <br />proof of right to enter or that this is not what is needed please let me know and T will <br />provide the necessary documents. A copy ofthe LEASE AGREEMENT is attached for <br />your convenience. <br />If we now meet the requirement to be considered a complete application package tet me <br />know quickly since time is of the essence and I must get the public notice to the local <br />newspaper in order to start the four (4) week time period.
