TFDS PERMIT is issued by the Mused Land Reclamation Board, DepaAmalt of Natural Resources,
State of Colorado.
RECITALS
A. The Pemrittee, B & D Trucking desires to conduct a minurg operation (mown as B & D
Trucking, for the purpose of extracting borrow material for omnstrudion. The Pernittee will not mine any
secondary wmmoditites.
B. On Jrme 28, 2001 the Mined Land Reclamation Board (the "Board") approved the Permutee's
applicatim for this pertnrt. fixed the amount ofthe financial warranty and directed that this permit be issued upon
the filing with the Division of Minerals and Geology (the "Division's of perfomlance wartanty and financial
warranty (or wanarrties) in the amount so fixed ur form and substance approved by the Divisim. Said warranties
have bear filed with the Division.
C. [f the Pemri7ae desires to extrdd materials odrer than those listed in (A), a separate Permit may
be required.
D. On June 28, 2001 the Board made the following findings:
1. The application for this permit complies with the requiremerrts of the Colorado Mined
Land Reclamation Ad for the Extraction ofConstmdion Materials, C.RS. 3432.5-101 et sew., as amarded, and
with all applicable local, state and federal laws;
2. The operation will nd adversely afied the stability of any sirgorifir~rt, valuable, and
permanent man-made swore located within two hundred feet of the Affected Land, except where there is an
agreement between the Operator and the persons having an interest in the swdure that damage to the swcture is
to be compensated for by the Pemrittee; and;
