The Pemrittee, B & D Trucking desires to conduct a minurg operation (mown as B & D <br />Trucking, for the purpose of extracting borrow material for omnstrudion. The Pernittee will not mine any <br />secondary wmmoditites. <br />B. On Jrme 28, 2001 the Mined Land Reclamation Board (the "Board") approved the Permutee's <br />applicatim for this pertnrt. fixed the amount ofthe financial warranty and directed that this permit be issued upon <br />the filing with the Division of Minerals and Geology (the "Division's of perfomlance wartanty and financial <br />warranty (or wanarrties) in the amount so fixed ur form and substance approved by the Divisim. Said warranties <br />have bear filed with the Division. <br />C. [f the Pemri7ae desires to extrdd materials odrer than those listed in (A), a separate Permit may <br />be required. <br />D. On June 28, 2001 the Board made the following findings: <br />1. The application for this permit complies with the requiremerrts of the Colorado Mined <br />Land Reclamation Ad for the Extraction ofConstmdion Materials, C.RS. 3432.5-101 et sew., as amarded, and <br />with all applicable local, state and federal laws; <br />2. The operation will nd adversely afied the stability of any sirgorifir~rt, valuable, and <br />permanent man-made swore located within two hundred feet of the Affected Land, except where there is an <br />agreement between the Operator and the persons having an interest in the swdure that damage to the swcture is <br />to be compensated for by the Pemrittee; and; <br />
