This letter will deal only with
certain issues identified in the DMG's Fourth Adequacy Review; it incorporates by reference all
previous responses to adequacy review letters issued by your office and the response of Banks
and Gesso, LLC to the technical issues raised in all adequacy review letters, including the
Fourth. The fact that this letter may address fewer than all of the issues raised in the DMG's
adequacy review letters should not be considered to be a waiver of CCDWP's rights to respond
to any objections or issues raised by any objections or the DMG in any of the Adequacy Review
letters to date.
In Section G of your letter, DMG requested specifically that CCDWP respond to
comments of the City of Black Hawk and Gilpin County in their letters of September 12, 2005;
this letter will address them to the extent they raise legal, as opposed to technical, issues.
I G00 STOUT STREET • SUITE 1400 • DENVER, COLORADO 80202
TELEPHONE: 303-892-1400 Fnc5lmaE: 303-892-1401 • www.bjorklindley.COM
