We want your favorable recommendation to your board. Since we have
professionally edited and prepared the document, we look forward to answering any questions and/or
providing any additional supporting documents. As the list of contributors, supplementary data and exhibit
content should demonstrate, we've spent a fair amount of time and money preparing these revisions. We
would appreciate knowing of any concerns as soon as is possible to try and recapture our development
schedule.
The submission is based on your September 9, 1997 letter to Agile identifying the azeas of our permit
application which "must be addressed by the applicant in order to satisfy the applicable requvements of
C.R.S. 34-32.5-101 et seq, and the Mineral Rules and Regulations of the Mined Land Reclamation Board."
We also reviewed all letters of concern written by any respondents and the division.
In October 1997 our general attorney, John McDermott, spoke to you about how you wanted our response.
He stated that the Division wanted us to incorporate the answers to the points and questions in the 9/9/97
letter in a revised exhibit document. The enclosed 3 ring binders aze the result of your request. Also, as a
convenience, your 9/9/97 letter is addressed prior to the exhibits. We have answered your points/questions
and noted where they are answered in the exhibits and supporting documents.
The applicarion has not been changed and is included as previously submitted. While there was an
understandable misunderstanding regarding our expansion plans, the project's layout, method of operation
or acreage have not been changed.
Copies have been filed in the Fremont County Court House, Fremont County Commissioners and Fremont
County Soil Conservation District office. Please advise if anything is required.
We're looking forward to fmish the permit with you. Thanks for your help.
Sincer ~y, I
~1
Y
~irC;=i1!c=D
Mitch Albert, Ph.D.
President
JAN ~ 21998
pWI016F 61 pIIIItlIr1~0 n /.+4uwBV
