the proposed permit area and will be avoitled, The report of findings may be fountl in
Attachment 5-3. Sites and the haulroad alignment are shown on Figures 1 and 2 of the
report (Attachment 5~3, Pages 2 and 3) and on Exhibits 5-1 and 5-2.
Summary of Agency Findings
Agency fintli ngs are documented in Actachme n[ 5-G entitled Pertinent Correspondence.
The Colorado State Historic Pres erva[i on Office concurred with WCRM~s findings [hat [he
sites iden[tfied in the 1979-1980 IJC RM inventory were not efigi ble for the Na[icnal
Register of Historic Places (see the letter dated May 11, 1988 from [he Deputy S[a to
Historic Preservation Officer to Peabody Coal Company in Attachment 5-4). These findings
were confirmed in a letter dated May 5, 1994 from the Bureau of Land Management Little
Snake Resource Arca Manager to Peabody 4estern Coal Company (Attachment 5~4 ).
the Bureau of Lantl Management (BLM) reviewetl the available information on the cultural
resources at the Yoast Mine and provided its comments in [he previously referenced letter
tlated May 5, 1994, In that letter, the 8LM agreed with the eligibility recommendations
• made by MAC in the 1992 report, but expressed concerns about certain aspects of the
archaeological recortls related to the proposed mine. These concerns included: 1) an
ei ghty-acre tract of land that was originally planned to be included in the permit area;
2) the lack of survey data in the haulroad corridor realignment areas; 3) the ability of
the operator to avoid prehistoric sites located within or near the permit boundary; 4) [he
true locations of certain s~[es; and 5) [he need for additional testing.
the BLM~s concerns were addressed in subsequent fieltl studies and correspondence, The BLM
is currently evaluating this information to determine if all archaeological concerns have
been addressed. Verification of these determinations will be placed in the permit
application when available. Additional work may be warrant etl depending upon their
findings.
Pending final BLM concurrence, it is believetl [not all necessary archaeological
inventories have been completed in the proposed Yoast Mine permit area. Testing has been
completed at relevant sites assotiat ed ui th the proposed permit, and no further work is
recommended. Assuming final approval is obtained, no impacts to cultural resources are
• anticipated as a result of mining at Yoast
3
