E, <br />SUBJECT: Hydrological Consequences of Trrin Pines PIo, 2 Mine on <br />Caldirolc No, 2 Mine l"Jell <br />1, Discussion of Problem: The town of Coal Creek owned water <br />rights which included a well at the Caldirola No, 2 Mine, <br />These rights vrere decreed in Case 2637 on February 14, 1916 <br />in the District Court of Fremont County, all with appropriation <br />date of March 5, 1884, and all are alternate points of diversion <br />granted by this vrater court in Case VJ-4221 on August 22, 1975, <br />In 1982 the tovrn of Coal Creek joined the city of Florence and <br />the town of Williamsburg in a joint water system, All of the <br />above water rights were abandoned to the stream system upon <br />completion of the water system, and equipment was removed <br />except that the Caldirola No. 2 Mine Well and the Williamsburg <br />Wells No. 1 and No, 2 can remain eeuipped and be used for <br />emergency or fire-fighting purposes, l'Jhen not so used, said <br />yells are to be capped and locked, The transfer and abandon- <br />ment of the vrater rights is explained in detail in Case No, <br />80C6'J93 filed in the District Court in and for 'later Division <br />• No, 2, State of Colorado, dated August 3, 1982 and recorded <br />in Book 679 Page 497, <br />As discussed in the Small Operators' Assistance Program or <br />S,O.A,P, Report prepared by J, F, Sato and Associates (included <br />in the Hermit application), the proposed workings of Twin Pines <br />IVo. 2 mine lie geologically downdip from the Caldirola rlo, 2 <br />S~Iine '!fell, Consequently, concern was expressed by the Land <br />Reclamation Division that the quantity of water in the well <br />would be affected by development of Tvrin Pines No, 2 Mine, <br />The concern was so indicated in proposed stipulations set forth <br />in the permit findings documents, This matter was not pursued <br />at an earlier date as the S. O, A. P, report expressed little con- <br />cern over the effect of the mining operation on surface or <br />underground vrater sources as stated in Section 2,04.7(3) <br />Alternate Water Supply Information, Page JFSA-57, of the J, F, <br />Sato Report, <br />2, Results of Investir;ation: After revievr of the preliminary find- <br />ings of the Land Reclamation 1ivision, an investigation was <br />initiated to further define the probable effect by the mine on <br />the well.
