Canary <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed all map, publication, and notification contents of your request for a <br />reconsideration of the previous Division approval of Hall Irvin Corporation's Regulaz 112 Application <br />for the North LaPoudre Pit. Providing no adverse public comments are received on or before December <br />15, 2003, the Division will offer a recommendation to the Mined Land Reclamation Board at the <br />December 16-17, 2003 Meeting that the application be approved. Upon a favorable decision by the <br />Boazd, the permit should also be issued since you have already provided the required $240,000 <br />reclamation bond. <br />Please note that the Current Conditions Map received on November 5, 2003 shows a 72" storm sewer, <br />owned by the Town of Windsor, along the east permit boundary. This structure was not shown on the <br />original mine plan map submitted in 2000. Should future excavation occur at the N LaPoudre Pit, the <br />stabilityof the structure should not be affected as long as the operator complies with the proposed mine <br />plan and setback distance of 55'. Also, for your benefit, I have enclosed copies of the original February <br />12, 2001 Reclamation Plan Map and Erosion Protection Berm Diagram. <br />Please call me at (303) 866-3567 if you have any questions. <br />Sincerely, <br />Thomas A.
