<br />8. Loveland will fence the area covered by the reclamation permit, <br />with a stock fence. <br />9. Loveland will maintain and stabilize finished slopes to a <br />ratio no steeper than two (2) horizontal to one (1) vertical. (The above <br />can revert to a less steep slope to conform to local zoning regulations). <br />10. Land stabilization and reclamation will be maintained for a <br />period of three (3) years after all mining activities cease, and if the <br />property is sold, leased, or transferred in any manner, the new owner, <br />lessee or person having control, must file a request to succeed operator <br />(LRB Form 7) with the Colorado Land Reclamation Board, and shall agree to <br />be bound to the unexpired period of the three year term. <br />11. If Loveland plans to discharge into a waterway, then a permit <br />to discharge into same will be obtained from the Colorado Water Quality <br />Control Commission. <br />12. Loveland will control erosion on or along haul roads by the <br />use of drainage ditches, culverts or check dams. <br />13. Natural drainways or drainways constructed to alleviate flood <br />conditions in the area shall be kept free from overburden, stockpiles and <br />topsoil. <br />14. Loveland will obtain permission from the local state authorities <br />before using water from any waterway, to prevent usurping any adjudicated <br />water rights. <br />15. Trailers and/or buildings used for office, storage and <br />maintenance shall meet local zoning regulations. <br />16. Special use or other forms of permits shall be obtained from <br />the county agency authorized to grant such permits. <br />17. Nothing in this agreement shall subrogate the operator's <br />responsibility for compliance with local county zoning requirements. <br />If any of the terms, conditions and requirements of this agreement <br />are violated at any time during the period of this agreement, the Land <br />-3- <br />
