Were you sworn in down there? <br />MR. COHEN: No, I wasn't, but I won't be putting on any evidence. I am a <br />lawyer and I represent the Costilla County Committee for Environmental <br />• Soundness. And most of those people will be -- some of those people will be <br />coming forward now, plus we have an expert witness who will give some <br />testimony. They certainly will be sworn in. At least those who haven't been <br />sworn in in Alamosa. I just want to introduce myself, Neal Cohen. I am a <br />lawyer with Ireland, Stapleton, Pryor and Pascoe, and, Melanie Rigg who is an <br />associate with me and helping me on this case, and at the same firm. Together <br />and with our witnesses, we would like to take this opportunity tai> thank the <br />Board and to present our information. I guess there has been a 'lot of <br />information, written documents, that have been presented. We hawe prepared a <br />fairly brief memorandum of the legal points and factual points and the <br />qualities that we would like to give you and ask your time to consider this. <br />One of the issues that we addressed in this brief, one of the points that <br />I think is a very important point that we would like to reserve time to <br />discuss, either in closing argument or at some other time when the Board is <br />interested, perhaps before that, has to do with the jurisdiction of this Board <br />to grant the permit based on the application presented. Mr. Banta made a few <br />opening remarks earlier about that issue and we feel that it's a very <br />
