<br />GENERAL TERMS AND CONDITIONS: QMPORTANTI READ ITEMS 8.7 AND 81 <br />1. This permit is issued in reliance upon the accuracy end completeness of inlonnatian supplied by the epplicent end is <br />conditioned upon conduction of the activity, or construction, instelleGon and operedon of the source, in accordance <br />with this information and with representedons made by the epplicent or applicant's eganta. It ie valid only for the <br />equipment and operations or activity specifically identified on the permit. <br />2. Unlaes specifically stated otherwise, the general end specific conditions contained in this permit have been determined <br />by the APCD to be necessary to assure compliance with the provisions of Section 25-7-1 14, C.R.S. and, ea such, shell <br />be enforceahle under the provisions of Section 25-7-115, C.R.S., the Clean Air Act, 42 USC Section 7502(61131; and <br />Air Quality Control Commission Regulation No. 3 SacGon IV.D.2. or 121 result in en exceedance of the NAAQS for <br />pollutants es required by Sections 25-7-105(111A1(1) and 201(1)(61. C.R.S., of the Clesn Air Act; 42 USC Section <br />7475(al(31: and Air Queliry Control Commission Rapuletion Na. 3, Section IV.D.1 .e. <br />3. Each end every condition of this permit is a material part hereof end is not aevereble. Any challenge to or appeal of, <br />a condition hereof shell constitute a rejection of the andre permit end upon ouch occurrence, this permit shall be <br />deemed denied eb inirio. This permit may be revoked at any tlma prior to final approval by the Air Polludon Control <br />Division (APCD) on grounds set forth In the Colorado Air Quality Control Act end regulations of the Air Queliry Control <br />Commission (AQCC), including failure to meat any express term or condition of the permit. <br />4. This permit end any required attachments must be retained end made available for inspection upon request et the <br />location set forth herein. With respect to a portable source which is moved to a new location, a ropy of the revised <br />Air Pollutant Emissions Notice (APEN) (required by law to be submitted to the APCD whenever a portable source is <br />ralocatedl should be attached to this permit. The permit may be reissued to a new owner by the APCD es provided <br />in AQCC Regulation No. 3 Section III.R. upon a request for transfer of ownership end the submittal of a revised APEN <br />and the required lee. <br />5. Issuance (initial approval) of en emission permit does not provide 'final' authodty for this activity or operation of this <br />• source. Final approval of the permit must be secured from the APCD in writing in accordance with the provisions of <br />25.7-114.5 C.R.S. end AQCC Regulation No. 3, Section IV.H. Final approval cannot be granted until the operation <br />or activity eommencea and has bean verified by the APCD es conforming in ell respects with the conditions of the <br />permit. If the APCD so determines, it will provide written documentation of such final approval, which does constitute <br />'final' authority to operate. <br />6. THIS PERMIT AUTOMATICALLY EXPIRES IF you 111 do not comments construction or operation within 18 months <br />attar either the date of issuance of this permit or the data on which such construction or activity was scheduled to <br />commence es set forth in the permit, whichever is later; (2I discontinue constmction for a period of 18 months or <br />more; or (31 do not complete construction within a reasonable time of the estimated completion date. Extensions of <br />the expiration data may be granted by the APCD upon a showing of good cause by the permittee. <br />YOU MUST notify the APCD et least thirty days (fifteen days for portable sources) prior to commencement of the <br />permitted operation or activity. Failure to do so is a violation of Section 25-7-114.5(1211e1. C.R.S. and AQCC <br />Regulation No. 3, Section IV.H.1 ., and can result in the revoeetion of the permit. ~~ <br />8. Section 25-7.114(51(el. C.R.S. requires that ell sources required to file en Air Pollution Emission Notice (APENI must <br />pay en annual lee to cover the costs of inspections end administration. If a source or activity is to be discontinued, <br />the owner must notify the Division in writing requesting a cancellation of the permit. Upon notification, annual tee <br />billing will terminate. <br />9. Violation of the terms of a permit which has received final eperovel or of the provisions of the Colorado Air Queliry <br />Control Act or the regulations of the AQCC may result in edministretive, civil or criminal enforcement actions under <br />Sections 25-7.115 lenfortementl, -121 (injunctionsl, -122 (civil penaltiesl, C.R.S. <br />• <br />
