i• <br /> <br />APPENDIX C <br />EXHIBIT 1d <br />PRIVATE COAL LEASES <br />Central Appalachia Mining, LLC - 50% <br />The right of CAM to enter into and mine in the private coal is based upon its ownership of <br />an undivided 50 percent interest in the surface and coat. The other 50 percent is leased to <br />CAM from three separate owners. The owners, lease dates and a history of the lease <br />record is detailed below: <br />Betty L. Branch - 25% <br />Mrs. Branch holds an undivided 25 percent interest in the fee lands and private coal. A 20 <br />year lease to mine coal by any method from the surface or underground was issued to <br />William E. Wise on December 29, 1977. The lease grants renewal rights and allows use <br />of water rights held by the lessee on the lands. The lease was assigned to Sheridan <br />Enterprises, Inc., on May 14, 1979; to Salt Creek on December 5, 1980; to Grand Valley <br />on October 16, 1992; to Lodestar on July 14, 1999; then to Central Appalachia Mining, <br />LLC, on May 19, 2003. <br />Katharyne E. Henry - 16.7% <br />Mrs. Henry holds an undivided 1/6 interest in the fee lands and private coal through <br />heirship and purchase. Half of that 1/6 was though heirship and half was through <br />purchase. In both cases the coal lease was attached to the property. The 20 year leases <br />to mine coal by any method from surface or underground were issued to William E. <br />Wise on December 29, 1977 for the inherited land and on November 2, 1978 for the <br />purchased land. The lease grants renewal rights and allows use of water rights held by <br />the lessee on the lands. The lease was assigned to Sheridan Enterprises, Inc., on May <br />14, 1979; to Salt Creek on December 5, 1980; to Grand Valley on October 16, 1992; to <br />Lodestar on July 14, 1999; then to Central Appalachia Mining, LLC, on May 19, 2003. <br />Josephine L. Hedman - 8.3% <br />Mrs. Hedman holds and undivided 1/12 interest in the fee lands and private coal. A 20 <br />year lease to mine coal by any method from surface or underground was issued to <br />William E. Wise on December 29, 1977. The lease grants renewal rights and allows use <br />of water rights held by the lessee on the lands. The lease was assigned to Sheridan <br />Enterprises, Inc., on May 14, 1979; to Salt Creek on December 5, 1980; to Grand Valley <br />on October 16, 1992; to Lodestar on July 14, 1999; then to Central Appalachia Mining, <br />LLC, on May 19, 2003. <br />~~ <br />
