Ralph Nix Produce, Inc. is the current owner of the subject property. Owens Brothers
Concrete Company has obtained the legal right to enter the proposed permit area for the
purposes of excavating and reclaiming the property through a contract for purchase of
the property. The owner has agreed to allow the Applicant to permit the property for the
purpose of sand and gravel mining. Please refer to the Agreement found in this Exhibit.
