<br /> <br />Banks and Gesso, LLC <br />EXHIBIT D -MINING PLAN <br />Overview <br />Owens Brothers Concrete Company proposes to excavate approximately 6.6 million <br />cubic yards (g.9 million tons) of sand and gravel from the Nix Property. The excavation <br />operation will begin upon approval of all permits, probably in late 2001, and will last for at <br />least 18 to 22 years under the expected mining rates between 450,000 and 550,000 tons <br />per year. The actual length of the operation is dependant on market conditions. <br />The Applicant proposes to develop the site as a sand and gravel mining and processing <br />operation. The ancillary and compatible use of concrete production may occur on-site <br />as well, but is not anticipated at any point in the near-term future. Only approximately <br />112 acres of the total permit area acreage of 312 acres is proposed for mining under this <br />permit (see Exhibit C-3, Mining Plan Map). An amendment to this permit will be applied <br />for when the Applicant desires to mine the remainder of the property at some point in the <br />future. Because of the size of the aggregate deposit and the anticipated mining rate, it <br />would not be practical to specifically plan the entire site at this time. Reserves will be <br />dry-mined. The aggregate processing plant and other related facilities will be located in <br />the southeast area of the property. <br />The post-mining land use of the property is envisioned to be unlined, open bodies of <br />water. The Reclamation Plan assumes the cost for restoration of the mining area as <br />open water bodies. All other areas will be reclaimed as natural pastureland for grazing <br />livestock. Reclamation is discussed in greater detail in Exhibit F, Reclamation Plan. <br />Mining Methods -Rule 6.4.4 (a) <br />The Applicant proposes to dry-mine the property. Initial mining will occur in the <br />southeast corner of the property, beginning with Area 1, and initially progress west and <br />then north toward the mining limits.
