• Banks and Gesso, LLC <br />INTRODUCTION <br />This document presents an application for a State of Colorado, Division of Minerals and <br />Geology, Colorado Mined Land Reclamation Board (CMLRB) Construction Materials <br />Regular 112 Operation Reclamation Permit. <br />The Applicant, Owens Brothers Concrete Company, is applying for this Permit to mine <br />sand and gravel from the proposed Nix property site, located in unincorporated Weld <br />County. The property consists of approximately 312 acres in the South '/z of the <br />Southwest %+, the West'/ of the Southeast'/+, and the entire Northeast'/+ of Section 28, <br />Township 3 North, Range 67 West of the 6`" PM. The site is located on the north side of <br />Weld County Road 28, approximately halfway between Interstate 25 and U.S. Highway <br />85. <br />The property is currently comprised of corn, onions, and other crops. There are several <br />oil and gas structures located on the site. Currently, Ralph Nix Produce, Inc. owns the <br />surface property and sand and gravel rights. <br />The sand and gravel produced from the site will be trucked to market by Owens Brothers <br />Concrete Company and independent haulers. Under proposed expected production <br />rates of between 450,000 and 550,000 tons per year, the life of the operation is <br />expected to be approximately 14 to 18 years. The actual time frame for the life of the <br />operation is highly dependent on market conditions. <br />Land uses immediately surrounding the site include limited residences, agricultural <br />lands, and one sand and gravel mine with a concrete batch plant to the north. Weld <br />County Road 17 borders part of the western end of the site. The Varra Sand and Gravel <br />Pit makes up the remainder of the western boundary. Weld County Road 28 runs the <br />entire length of the south end of the property. Neighboring farm lands and a sand and <br />gravel mine border the north of the project site.
