MAY. 4.1998 4~01PM H~ CROSS ELECTRIC • N0.480 P,3 <br />to any and all claims and injury, including, but not limited to: (a) Claims asserted by any <br />person or entity, including, but not limited to, third parties, employees of Gallegos or its <br />contractors, subcontractors, or their employees; (b) Claims arising or alleged to be <br />arising In any way out of the existence at or near the premises due to this agreement of <br />the Faculty, electricity, or electromagnetic fields; or (c) Claims arising from, or alleged to <br />be arising in any way from, the acts or omissions of Gallegos, its sublessees, Invitees, <br />agents, ar employees. <br />Further, Gallegos shall contact the Association dispatch at (970) 945-5491 at least five <br />(5) working days prior to the commencement of any Activities within the Association <br />easement area, and NO Activity shall be performed until a representative of Association <br />has reviewed the Activity that Is adjacent to and within the Association right-of--way. The <br />instructions of such representative relating to the safety of the Association Facility shall <br />be followed by Gallegos, its agents, and employees. Any damage tv the Facility shall be <br />paid far or repaired at the expense of Gallegos.
