Please find enclosed, copy of a request for administrative appeal of DMG's October 20,
1999 approval decision for the Brown Derby Mine application; copies of additional
supporting documents are also enclosed. The request for appeal was submitted by Robert
E. Wright, Jr., attorney for the owners of the McLain Ranch.
In accordance with the thirty 130) day notice requirement of Rule 1.4.214), DMG may
schedule the issue for the February 23-24, 2000 Board meeting.
Please advise regarding the necessity of aPre-Hearing Conference. Should aPre-Hearing
Conference prove necessary, staff must request that the Board appoint an officer during
the January 26-27, 2000 Board meeting.
