1

EXHIBIT D (Cont'd)
6lining will occur in five stages so as to minimize surface

1
1
t

disturbance at any one time (see map Exhibit D-1). As the mineral
in Stage O nears depletion, it will become necessary to begin
Stage 1 so that the proper mixes of clay may be maintained (see
discussion of geology later in this Exhibit D). Thus, while mining
is nearing completion on the south end, mining will begin just north
of the Church Ditch and proceed in a northerly direction. When
mining starts on the north end of the property, it will be necessary
for the operator to construct a ditch crossing. The exact point of
crossings cannot be selected at this time. However, they will be
constructed within a couple hundred feet of where shown on map
' D-1. The operator will use pipe at least 36 inches in diameter
' and of sufficient length to accommodate the expected traffic. Under
the lease agreement~withhir.?vfarcus Church the operator is responsible
' for the good condition of these ditches where they cross the lease
area (.see appendix, page 37).
Stage O will be six and one-half years while Stages 1 and 2
' will each be six years in length. Stage R (for roads) will be
ten years extending over the remaining life of the mine. Approxi-
' mately 1.32 acres of Stage B.L. will be backfilled and 2.56 total
acres regraded during the closing years of Stage O. Each of the
' five stages will be followed by a reclamation phase. (See Exhibit E,
' Reclamation Plan.)
The pit is operated year-round by Lakewood Brick as a source
for various clays used in its operations.
1
' 6 (Revised)
