II~ IIIIIIIIIIIIIIII <br /> <br />~~~ ti ~ ~6;~f L ~ <br /> <br />SAND AND GRAVEL LEASE <br />THIS LEASE made and entered into by and between KENNETH EUGENE <br />:/Pa <br />A1'ERS, Lessor, and I~IELVIN GEIB, ~„ Lessee. <br />Lessor leases to the Lessee the East Half (Ez) of the Northeast <br />(?uarter (NEa) of Section Seven (7), Township Eight (8) North, Range <br />Sixty-five (65) {Vest of the 6th P.nI., Weld County, Colorado, for the <br />purposes of excavating and removing therefrom sand and gravel, and to <br />operate therein a gravel pit. The right shall be exclusive in the <br />I.~essee during the term of the lease. <br />The lease shall extend from January 28, 1976 for a period of <br />twenty-five (25) years, to January 28, 2001. <br />The Lessee agrees to strip and stockpile the overburden and when <br /> <br />the areas of excavation are completed, to cover the same with the <br />overburden material, to the depth of not less than one foot. All <br />excavations shall be sloped in accordance with good practice and the <br />Lessee shall be responsible for all of the operations on the premises, <br />including any liability involved in connection with the operation of <br />the gravel removal business. Lessee agrees never to excavate down to <br />the water line so that at no time will there be water exposed in the <br />€;ravel excavation or gravel pit. It is intended at all times that this <br />shall be a dry gravel pit. <br />As rent for the lease, the Lessee agrees to pay to the Lessor at <br />the rate of twenty-five cents ($.25) per ton for the gravel removed, <br />the rental being payable at the end of each month for the gravel excavated <br />in the preceeding month. At the end of each month, the Lessee shall <br />furnish to the Lessor an itemized statement showing the dates and the <br />tonnage removed of sand and gravel, and shall, on or before the fifteenth <br />day of the month following the completion of the prior month's gravel <br />removals, furnish the statement and make payment for rental at the <br />above rate. <br />-1- <br />/~ ~~ .
