2Co0 -032 E <br />• <br />ASSIGNMEN'T' OF FEDERAL COAL LEASE <br />THIS ASSIGNMENT, made this ~SY day of ~~nf~-r^bf2--, 1994, <br />by PEABODY COAL COMPANY,. a Delaware corporation, whose address is <br />1300 South Yale Street, Flagstaff, Arizona 86001 ("Assignor") to <br />SENECA COAL COMPANY, a Delaware corporation, whose address is 1300 <br />South Yale Street, Flagstaff, Arizona 86001 ("Assignee"). <br />Assignor, in consideration of Ten Dollars and other valuable <br />consideration ($10.00+) paid by Assignee, the receipt and suffi- <br />ciency of which are hereby acknowledged, does ASSIGN AND TRANSFER <br />to Assignee, and to its successors and assigns, forever, all of <br />Assignor's right, title and interest in and to that certain Coal <br />Lease ("Lease") from the United States of America which bears <br />serial number C-081258 and which embraces certain real estate <br />("Federal Property") located in Routt County, State of Colorado, <br />which Federal Property is described as follows: <br />Township 5 North, Ranc7e 88 West. 6th P.M. <br />Section 23: All <br />Section 26: All <br />Section 27: NE ;, N2SZ <br />Section 33: NE4 <br />Section 34: NW4 <br />Section 35: Lots 3-6, inclusive, Lots 11 and 12, NE; <br />• <br />Assignee accepts the foregoing Assignment subject to the <br />overriding royalties and agreements identified on Exhibit "A" <br />attached hereto and made a part hereof. <br />Exhibit "A" to the extent they pertain to the Lease. <br />Assignee accepts the foregoing assignment and hereby assumes <br />and agrees to pay and discharge all obligations and liabilities <br />of Assignor under the Lease and the agreements identified on <br />IN WITNESS WHEREOF, Assignor and Asignee have executed this <br />Assignment as of the day and year first above written. <br />ATTEST: <br />ASSIGNOR: <br />PEABODY COAL COMPANY, a Delaware <br />corporation <br />~~ <br />Vice-President <br />• 260-032 (E) <br />
