Introduction <br />• <br />Peabody Coal Company constructed a coal haulage road between Routt County Road 53 and the <br />Hayden Station Power Plant during 1989. Easements and/or Special Use Permits were obtained from <br />the various land owners. A portion of the road had already been constructed from Road 53 to the <br />Hayden-Gulch Mine Tipple (W.R. Gracel. Peabody Coal Company tied this existing road with their <br />construction. The intersection of the H-G road and Peabody's is at approximately the NE corner of <br />Section 22, T6N, R88W. Exhibit 3-4 shows the various easements and adjacent land owners. <br />Peabody Coal Company transferred atl surface ownership to Seneca Coal Company on July 1, 1994. <br />Seneca Coal Company owns approximately half of the area traversed by the haul road. <br />Easement <br />Grantor: Erwine, Howard & Ethel (Deceased) <br />Easement: The south 200 feet of the south half southwest quarter, Section 14, T6N, <br />R68W. <br />Grantee: Seneca Coal Company <br />Easement 1260-024) <br />• Grantor: Darrel S.
