• During construction, a registered professional engineer will ensure that <br />all construction is accomplished according to design and applicable <br />regulations. The sedimentation pond embankment and surrounding areas <br />disturbed by construction will be seeded after the embankment is <br />completed. The active upstream side of the embankment where the water <br />will be impounded will be riprapped or otherwise stabilized. Areas in <br />which vegetation is not successful or, where rills and gullies develop, <br />will be repaired and revegetated. <br />The sedimentation pond will remain in place after the termination of <br />mining activities. The pond will not be removed until the disturbed <br />area is reclaimed, and herbaceous cover of the revegetated area complies <br />with the standards set forth in Section 4.15.7. <br />The Bear Coal Company will examine the sedimentation pond periodically <br />and file a report on the condition of the pond annually. <br />• 4.05.7 Discharge Structures <br />Discharge from the sedimentation pond will be controlled by the use of <br />an energy dissipater and flow check devices where necessary. The water <br />released from the pond will travel through spillways lined with riprap, <br />gravel, or natural vegetation before being discharged into the existing <br />drainage. <br />4.05.8 Acid-Forming and Toxic-Forming S <br />Acid-forming and toxic-farming materials do not exist within the <br />overburden or underburden of the C Coal Seam. A discussion on the <br />overburden and underburden has been set forth in Section 2.04.6. <br />4.05.9 Permanent and Temporary Impoundments <br />No permanent impoundments are planned at the Bear No. 3 Mine by the Bear <br />• Coal Company. <br />4.05-7 <br />
