Upon completion of mining and at an <br />appropriate point mandated in the Coal Regulations of the Colorado Mined <br />Land Reclamation Board, temporary diversions will be reclaimed as <br />required in Section 4.05.17. Additional information on removal and <br />reclamation of temporary diversions is found in Section 2.05.4. None of <br />the proposed temporary diversions will be located so as to increase <br />potential for landslides. Channel lining riprap and energy dissipators <br />will be used when necessary. The Bear Coal Company does not anticipate <br />that there will be any significant excess material resulting from the <br />construction of diversion ditches. <br />No permanent diversions have been designed or will be constructed at the <br />planned operation. Likewise, none of the temporary diversions will <br />handle runoff from an area with a watershed greater than one square <br />mile. <br />None of the proposed diversions will drain into the underground <br />• operation. <br />4.05.4 Stream Channel Diversions (Relocation of Streams <br />The Bear Coal Company will divert or relocate no intermittent or <br />perennial streams within the permit area. Therefore, the requirements <br />of this Section are not applicable to the operation. <br />The Colorado Division of Highways has plans to move the North Fork of <br />the Gunnison River in an area adjacent to the planned Bear No. 3 Portals <br />surface facilities. This relocation will be conducted completely by the <br />Division of Highways or their authorized representative and will be used <br />to facilitate highway construction. <br /> <br />4.05-4 <br />
