Please be advised that a serious <br />water quality problem exists due to untreated mine water coming from the American <br />Tunnel draining the Sunnyside Mine water to Cement Creek, a tributary to the <br />Animas River. A discharge permit was issued for the untreated water. Standard <br />Metals did not meet the July 1, 1977 deadline of the permit conditions for <br />treatment of the mine water but instead has asked for an adjudicatory hearing <br />regarding the permit. Negotiations have been in progress toward an acceptable <br />compliance schedule for treatment of the water. A date for the adjuclicatory <br />hearing has not been set. <br />There is a discharge permit for the tailings pond effluent associated with the <br />Mayflower Mill operation. Recent sampling by the EPA shows non-compliance of <br />the discharge with permit conditions. Investigation is still in progress by <br />EPA relative to this discharge.
