Long <br />Division Director <br />On 1 1 /13197, DMG received your payment for the Act and Rules and Regulations, <br />previously provided on 10/29/97. Please find enclosed, receipt no. 4720, for the $8.00 <br />payment. Thank you for the prompt payment. <br />On 11 /13/97, DMG also received your letter, dated 11 /1 1 /97, addressing equipment at <br />or near the proposed Stone Gravel Pit site, and requesting an "onsite survey". Pursuant <br />to the possible mining/prospecting issues identified within your letter, DMG will conduct <br />an on-site inspection of the proposed Stone Gravel Pit site in the near future. However, <br />please note that DMG jurisdiction is limited to mining and/or prospecting issues, as <br />defined in the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials, 34-32.5-101 et seq., C.R.S. (1995 Repl. Vol.), and the Construction Materials <br />Rules and Regulations of the Colorado Mined Land Reclamation Board. <br />A statement in the third paragraph of your 11/11/97 letter, is incorrect. The following <br />clarification is provided for the record. <br />Third paragraph of your 11/11/97 letter states, "...You called me back at <br />approximately 10:00 a.m. to let me know that it was confirmed that the person <br />owning the grazing rights was cleaning out the pond and that the equipment <br />probably was owned by Norman Utley." <br />Clarification -After our phone conversation from 1 1 /7/97, I contacted Clyde <br />Johnson of the BLM, to inquire whether BLM had authorized anyone to utilize <br />equipment at or near the proposed Stone Gravel Pit site. Mr. Johnson indicated <br />that BLM had authorized the grazing permittee to excavate sediment from an <br />existing stock pond. Mr. Johnson did not indicate to me that Norman Utley was <br />involved. At no time during any of our phone conversations have I mentioned <br />Norman Utley, nor have I suggested that Mr. Utley may be involved. <br />
