Cottony <br />Upland Gravel, Inc. <br />542 33 Road Division Director <br />Natural Resource Trustee <br />Clifton, Colorado 81520 <br />Re: Upland Gravel Pit #3,112c Application No. M-2005-077, Approval <br />Dear Mr. Rinderle: <br />The Division of Minerals and Geology has finished the review of the above referenced application. <br />Upland Gravel's responses to the Division's Adequacy Review appear to have corrected or clarified <br />issues noted by Field Office staff. Upland gravel has agreed to the Division requirements of a minimum <br />of two feet of overburden and 1 foot of topsoil be placed on the underlying shale during reclamation and <br />during mining activities, no shale shall be exposed for more than 180 days at any one time to help <br />reduce possible selenium exposure. Therefore, staff is please to inform Upland Gravel that the above <br />reference application is approved. <br />Staff has calculated the Initial Reclamation Liabilitv Estimate for the nroroosed activities to be <br />$57,785.00. The estimate is based on the reclamation of Phase 1 and 2 as well as the haul road. Upland <br />Gravel has accepted the estimate by staff. Please note the permit will not become active until the <br />Division accepts the bond. No activities associated with the mining permit may begin without the bond <br />in place. Additionally, prior to the beginning of operations, Upland Gravel should contact both the <br />Division and BLM. The BLM stipulations will be noted in the permit file.
