Catlany <br />Division Director <br />Natural Resource Trustee <br />Re: Upland Gravel Ptt #3, ll2c Application No. M-2005-0~ equacy Review and~nitial `~ <br />Reclamation Liability Estimat~ <br />Dear Mr. Rinderle: <br />The Division of Minerals and Geology has finished the review of the above referenced application. <br />Upland Gravel's responses to the Division's Adequacy Review appear to have corrected or clarified <br />issues noted by Field Office staff The Division will require a minimum of two feet of overburden and 1 <br />foot of topsoil be placed on the underlying shale during reclamation. Also, the Division will require that <br />no shale be exposed for more than 180 days at any one time to help reduce possible selenium exposure. <br />Staff has calculated the Initial Reclamation Liability Estimate for the proposed activities. The estimate <br />is based on the reclamation of Phase 1 and 2 as well as the haul road. Projected timelines reflect the <br />disturbance in these areas will last into 2010. The Division does periodical updates every 3 to 4 years so <br />this estimate is in line with work and reclamation as proposed. Please review the estimate and notify <br />staff if there are any errors or clarifications that effect the calculations. If Upland agrees with the <br />estimate, verbal acceptance followed by written agreement is all that is needed to make a decision on the <br />application.
