Pit - File no. 77-53 <br />Dear Mr. Andersen: <br />Our Division has received the copy of the lease with the landowner of the <br />site of the above captioned operation. This appears to be in order as the <br />source of legal right to enter the site. We also received the executed <br />performance warranty for this operation. It is adequate except that the <br />legal description to the nearest at, section must be appended to it as exhibit <br />A. As soon as you give me this legal description, I will add it to the per- <br />formance warranty, making it totally adequate. I will plan to make the same <br />addition to the financial warranty (when we receive it), as necessary. <br />As I mentioned to you during our telephone conversation of this morning, you <br />still need to reply to my letter to Mrs. Powell of April 2, 1982. I have enclosed <br />a copy of this letter. During my review of this letter, I uncovered one <br />problem that nlay not permit the application to be considered by the Board <br />during this month's meeting. On the last page of the letter, you will note <br />that I have described the publication procedure that must be completed before <br />the Board can consider the application. The landowner of the pit, as well as <br />any immediately adjacent landowners, must also be notified by sending them <br />each a copy of the first publication by certified mail. Proof of these notifi- <br />cations must then be sent to our Division. Since the publication must be done <br />for two sequential weeks in a local newspaper, I do not feel that there will <br />be time for this to be completed before the August 25-26, 1982 meeting of the <br />Board. <br />Considering all of the matters that I have outlined so far, I reluctantly <br />suggest that you request one final continuance until the September 22-23, 1982 <br />Board meeting so that the publication and the notifications can be completed. <br />This will also give you time to finish preparing an answer to the enclosed <br />letter. In order to help you in doing the publication, I have enclosed a copy <br />of our publication format. I have also enclosed a copy of Mrs. Powell's <br />application for this pit so that you may add to it, as necessary. Finally, I <br />have enclosed a copy of our present limited impact permit application form so <br />that you may sign the last page of it and return it to our Division. <br />Please call me if I can answer any questions or otherwise offer any assistance <br />in any of the matters mentioned in this letter. <br />
