Long <br />Division Director <br />THIS PERMIT is issued by the Mined Land Reclamation Board, Departmart of Natural Resources, <br />State of Colorado. <br />RECITALS <br />A. The PemriVee, City of Greeley desires to conduct a mining operation lmown as 25th Avenue <br />Site, for the purpose of extracting sand and gravel The Pemuttee will not mine any secondary commodities. <br />B. On May 30, 2002 the Mined Land Reclamation Board (the "Board") approved the Pemrittee's <br />apphcation for this permit and drrected that this permit be issued upon the filing with the Divisicn of Minerals and <br />Geology (the "Division") of performance warranty approved by the Division. Said warranty has been filed with <br />the Division. <br />C. If the Pemtittce desires to extract materials other than those listed in (A), a separate pemrit may <br />be regrdred. <br />D. On May 30, 2002 the Board made the following findings: <br />1. The application for this permit corr>plies with the requiremarts of the Colorado Mined <br />Land Reclamation Ad forthe Extraction of Constnrction Materials, C.RS. 3432.5-101 ~ sue., as amended, and <br />wick all applicable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any significant, valuable, and <br />permanent man-made stmchrre located within two hundred feet of the Affected Land, except where there is an <br />agreement betwear the Operator and the persons having an interest in the structure that damage to the structure is <br />to be compensated for by the Permittee; and; <br />
