<br />• First, the applicant assumes the Division is referring to the 13.2-acre wetland in [he Phase <br />I area, not the 32.2-acre area, and the following applicant response is based on this <br />assumption. <br />The applicant proposes to create a wetland area in the Phase I area and, if necessary, <br />submit a revegetation plan and cost estimate as a technical revision to the application at a <br />later date. The applicant believes that, because of variability in the mining operations and <br />the possibility of natural revegetation, providing specific grading and revegetation plans <br />and reclamation cost estimates is impractical at this time. <br />Therefore, the applicant proposes, for the purposes of estimating reclamation costs, an <br />alternative reclamation plan and itemized tasks as described in the Division's Alternative <br />#2 (backfilling the excavation to at least two (2) feet above the ground water table, <br />topsoiling, and reseeding to provide a stable vegetative cover). The itemized altemative <br />reclamation plan is provided in Line J of the revised Reclamation Cost Estimate, Exhibit <br />L (Attachment A2). The alternative reclamation plan is also illustrated on the revised <br />Reclamation Plan Map, Exhibit F, in Attachment B2. <br />13. The Division requests that the applicant provide a map (revised mining plan map) showing <br />the location of the 2 registered wells within 600 feet of the proposed site, and a commitment to <br />secure an OSE approved well permit prior to exposure of ground water at the Tanabe Pit. <br />• The Pre-mining/Mining Plan Map, Exhibit C, has been revised to show the location of the <br />two wells. The revised map is included in Attachment C2. The applicant has sent <br />certified letters requesting waivers to each of the well owners. Copies of the letters are <br />included in Attaclunent D2. <br />A Substitute Water Supply Plan has already been accepted by the State Engineer's Office <br />for ground water losses during mining and reclamation activities at the proposed Tanabe <br />site. A copy of the approval letter is included in Attachment D2. The applicant has also <br />submitted a well permit application to the State Engineer's Office for [he proposed gravel <br />pit. The applicant conunits to having the approved well permit prior to exposure of <br />ground water at the proposed Tanabe site. <br />Response to Comments Received from Mr. Tom Schreiner, June 1, 2000. <br />3. The stability analysis provided and reconunended setback distances as depicted on the revised <br />Exhibit C, Pre-mining & Mining Plan Map cannot be accepted at this time. The Division will <br />accept a minimum setback distance of twice the depth of the pit excavation as measured from the <br />toe of the excavation to any permanent man-made structures that are within 200 feet of the <br />affected land. <br />• Based on Division's concerns regarding the slope stability analysis, the applicant <br />proposes to use twice the depth of the pit excavation, as measured from the toe of the <br />excavation, as setbacks from any permanent man-made structures that are within 200 feet <br />of the affected land. These setbacks are ilhistrated on [he revised Exhibit C, Pre- <br />mining/Mining Plan Map included in Attachment C2.
