Ranee 67West of the 6th P.M. <br />Section 31: E/2SE/4 <br />Weld County, Colorado <br />Gentlemen: <br />The purpose of this letter is to inform you that Kerr-McGee's oil and gas rights may be <br />adversely affected by the Regulaz Construction Materials Operation Reclamation Permit currently <br />proposed by Asphalt Specialties Company. <br />KMRMC has not received the notice of this development that is required by Colorado <br />statute, and with this letter lodges an objection to approval of the development application. <br />Applicants seeking approval of development plans from a local government aze required <br />to provide notice of such application to the mineral estate owner of the affected lands not less than <br />thirty days before the date scheduled for the initial public hearing on the application for <br />development. C.R.S. '24-65.5-103(1)(a). In addition, applicants aze required to provide notice of <br />severed mineral rights ownership to the local government authority considering the application for <br />development, C.R.S. '24-65.5-103(1)(b). Development applicants must provide the local <br />government authority with a list of mineral owners and other affected property owners, and such <br />persons must be given notice of any heazing that would affect their property interests at Least thirty <br />days before local government acts on any application for approval of a plat. C.R.S. <br />'31-23-215. The Commissioners may not approve an application that does not comply with these <br />notice requirements. <br />As the owner of mineral rights in the subject property, KMRMC was entitled to receive notice of <br />the proposed development at least thirty days prior to the hearing date. It did not receive such <br />notice from either the applicant or the state, and must therefore object to the proposed development <br />
