(y will stockpile and retain topsoil wherever <br />possible. <br />2, __(~~ OA n/ l will obtain a permit to discharge into a water- <br />way from the Environmental Protection Agency and will abide by the regula- <br />lions pertaining thereto or those set by the Colorado Water Quality Control <br />Commission. <br />3. will control erasion on or along haul roads <br />by the use of drainage ditches, culverts or check dams. <br />4. will backfill all open pits to as near the <br />original contour as possible. <br />5. --~~ will cover any acid forming material in the <br />exposed face of the seam, ox that which has been mined, to a depth of not <br />less than six (6) feet with overburden or spoil material. <br />6. -_~~ will grade and stabilize any surface area <br />disturbed by this operation and revegetate the area, following the best <br />information available from qualified organizations or persons. <br />7. Plan and agreement will be updated annually so that new <br />techniques can be utilized as they are produced or found. <br />8. Land stabilization and reclamation will be maintained for a <br />period of five years after all mining activities cease, and if the property <br />is sold, leased or transferred in any manner, the new owner, lessee or <br />person having control shall agree to be bound to the unexpired period of <br />the five-year term, <br />-2- <br /> <br /> <br />
