No attempt was made to delineate wetlands in the flood plain on the south side of the primary channel as <br />. potential distarbance is to be limited to the north side, Casual observation of this area indicates portions would <br />likely qualify as wetland using the Cowardin System; however the majority of this area would most likely not <br />meet the soil and hydrology parameters applied by the COE. <br />Based on the findings of this survey, it is concluded that the area(s) disturbed for the 18 Right Ventilation Shaft <br />pad and associated access roads do not impact jurisdictional wetlands or other Waters of the U.S. <br />RULE 2.04.] 1 -FISH AND WILDLIFE RESOURCES INFORMATION <br />(11 Each anplication shall include a study offish and wildlife and their habitats within the r~rooosed <br />permit area and portions of the adjacent area as determined by the Division, or in the case of undereround <br />minine, only those areas within the pronosed permit area and nortions of the adiacent area as determined by the <br />Division where surface minine will be conducted or facilities located and the portions of thepermit area where <br />effects on such resources may reasonably be expected to occur. <br />(2) Prior to initiatine such studies, the aoplicant shall contact the Division to determine what fish <br />and wildlife resources infornation will be r~uired. <br />(31 The Division, in consultation with the anoronriate State and Federal fish and wildlife manaeement, <br />conservation, or land manaeement agencies havine resnonsibilities for fish and wildlife or their habitats, shall <br />determine the level of detail and the areas of such studies, according to: <br />(a) Published data and other information; <br />(bl Site-specific information obtained by the applicant; and <br />r <br />U <br /> <br />TR 04-44 2.04-61.2 08!04/04 <br />
