Effective November 8, 1987 the two (2) acre exemption no <br />longer applies in Colorado. This 1s due to the passage of Federal Law 100-34 <br />which effectively prohibits the two (2) acre exemption in any state. The <br />reason apparently was because of some abuses of the exemption back east. At <br />this point you need to apply for a permit unless the extraction is less than <br />250 tons or for nonprofit private use. <br />The Trinidad Basin mine as you know is inactive. The permit for the mine was <br />suspended by the Mined Land Reclamation Board due to a pattern of violations <br />at the site on November 14, 1984. Subsequently, the permit expired on <br />Uecember 13, 1y87. This means that there is no valid existing permit for the <br />mine for you to take over. <br />A new permit could be obtained using information from the old Trinidad Basin <br />application but it would need to be updated. The permit process takes from <br />three (3) to twelve (12) months or more with the average time of six (6) <br />months if all information is readily available. <br />If you disire to obtain a permit we would suggest you meet with us to discuss <br />information requirements.
