Box 472 <br />Montrose, CO 81402 <br />RE: Spring Creek Gravel Pit, Permit No. M-94-097 <br />Dear Ms. Loper: <br />Received and reviewed your letter dated November 3, 1995. <br />I will try to answer your question regarding the proper or improper use of the "Notice of <br />Filing Application for Colorado Mined Land Reclamation Permit" form. Hopefully, this <br />will provide enough information to have answered all of your questions. <br />The Spring Creek Gravel Permit application was filed (submitted) with the Division of <br />Minerals and Geology on September 6, 1994. The application was deemed incomplete <br />and a letter was sent to the applicant on September 16, 1994. One of the reasons [he <br />application was deemed incomplete is because the applicant failed to submit proof that <br />the above noted form was sent to the county. The applicant is required to notify the <br />County Commissioners, and possibly the Soil Conservation Service, prior to submitting <br />the application to the Division. Then send proof to the Division that the county was <br />notified when the application is submitted. Proof can be in the form of a certified return <br />receipt (which the county signed on September 12, 1994), a signed copy of the notice, <br />or any other proof positive that the County received the notice. <br />The submittal of the "Notice" form to the county on September 12, 1994 was not <br />improper. <br />If you are still confused, since you have asked so many questions over the last several <br />months, let me know.
