Box 472 Montrose, CO 81402 RE: Spring Creek Gravel Pit, Permit No. M-94-097 Dear Ms. Loper: Received and reviewed your letter dated November 3, 1995. I will try to answer your question regarding the proper or improper use of the "Notice of Filing Application for Colorado Mined Land Reclamation Permit" form. Hopefully, this will provide enough information to have answered all of your questions. The Spring Creek Gravel Permit application was filed (submitted) with the Division of Minerals and Geology on September 6, 1994. The application was deemed incomplete and a letter was sent to the applicant on September 16, 1994. One of the reasons [he application was deemed incomplete is because the applicant failed to submit proof that the above noted form was sent to the county. The applicant is required to notify the County Commissioners, and possibly the Soil Conservation Service, prior to submitting the application to the Division. Then send proof to the Division that the county was notified when the application is submitted. Proof can be in the form of a certified return receipt (which the county signed on September 12, 1994), a signed copy of the notice, or any other proof positive that the County received the notice. The submittal of the "Notice" form to the county on September 12, 1994 was not improper. If you are still confused, since you have asked so many questions over the last several months, let me know.
