I appreciate your candid submission on this matter and <br />have added it to the permit file for this operation. I also felt that some <br />response from us was needed. <br />I agree with you that the permit should be amended as soon as possible to <br />include all disturbed areas (and to revise the amount of the financial <br />warranty, accordingly). If the amendment can also incorporate future plans <br />for a larger area (which would have been submitted at some point, in any <br />case), this is also a good idea. I encourage you to submit an appropriate <br />amendment application as soon as possible. <br />I am somewhat troubled, however, by the time lag discussed in your letter. If <br />our Division does not receive an application until the end of April, the area <br />involved would not be permitted and covered by appropriate financial warranty <br />until the end of July. I feel that this is much too long a time period for <br />this to go on. I propose that an amendment application be submitted to us by <br />no later than March 5, 1985. This could be the amendment for the entire <br />planned area or merely an amendment to take in the 3.3 acres that have been <br />disturbed outside of the permit area, to be followed with a second amendment <br />to take in the other planned areas.
