RG: Connell Resources' Wellington Downs pit
Dear Mr. Grant,
This letter is in response to the Grant Property-Agreement to
allow mining within 2D0 feet of the Grant Establishment and the
commitment to use shares of Box Elder Ditch water for the f111ing
of your reservoir. These concerns were raised by the Division, of
Minerals and Geology after reviewing Connell Resources application
for a 112 Regular Use mining permit. Please confirm the following
statements:
1) You have no objections to Connell Resources, Inc. mining
within .200 feet of your home and other buildings located at
your establishment.
2) Your lease agreement with Connell allows Connell to remove any
objects that fall within the gravel pit limits such as an
irrigation ditch used to water crops on the center and west
side of the property. As your lease with Connell states,
Connell will be responsible for providing access for
irrigation waters as long as there is farmable ground on the
Wellington Downs property

33 You intend to utilize, but areYlimited to, the following
options to fill your water storage reservoir at/or by the
completion of mining: 1) hire an attorney and proceed through
water court to (a) change the use of your 2 1/2 shares of the
Box Elder Ditch for the purposes of filling the reservoir;
andlor (b) establish a new }union water storage right: 21
lease out the reservoir for water storage.
If you have no objection to the above statements, please sign and
date below and return the original to us.
