• • EXHIBIT S <br />PERMANENT AND MAN-MADE STRUCTURES <br />There are no man-made structure within 200 feet of the <br />affected lands except the Siloam Road that runs along a section <br />of the west permit area. There are no wells, pipelines, water <br />storage impoundments, railroad tracks, cemeteries or <br />communication antennas within 200 feet of the affected lands. <br />The site does have a fence along the west side of the area <br />to be mined; close to and parallel to Siloam Road. A fence also <br />runs along Red Creek Road on the north side of the mine. An <br />underground communications line runs parallel to Red Creek Road <br />on the north, this line appears to be buried 5 feet inside the <br />fence. There are two bridges on Siloam Road on the north west <br />side of the mine. Neither of these structures will be disturbed <br />by mining. In this area mining will be confined to removing <br />decorative and building stone from the surface of the land. This <br />removal will not create an excavated area below the existing <br />ground surface that would harm these structures. <br />A powerline runs across the parcel west of Siloam Road. It <br />enters the site from the south, crosses the west parcel to a <br />build west of the mine area. We will not impact this line with <br />mining because the location of the line and our method of mining <br />is flexible enough to avoid disturbing the line. We will not <br />mine slab rock within a 50 foot radius around each pole and will <br />make sure access to each pole is preserved. We will be <br />discussing the proposed mining method with San Isabel Electric <br />Association and will be working on an agreement with them that <br />will allow us to mine within 200 feet of each pole. <br />42 <br />
