The proposed topsoil stockpile is outside the permit area. All affected
land must be within the area to be permitted. The Staff has the following
recommendation.
Place topsoil from the first cut or phase of mining, on the area
where the 2nd cut or phase of mining will occur.
Upon completion of mining in phase one, return topsoil to affected
land along with topsoil from phase two.
Upon completion of phase two mining, topsoil from phase three can be
spread over phase two, and so on until the entire site is mined.
In this way, reclamation can occur concurrently with mining. Access
for each phase should follow one side of the permit area in order to
avoid redisturbing lands undergoing reclamation.
If the operator can minimize the amount of disturbance to 2 acres major,
2 acres moderate, and 2 acres minor disturbance (as defined under Rule
2.12(4)(d), the Staff would be agree with the $2,500.00 bond proposal, in
consideration that reclamation is concurrent with mining.
2. The enclosed letter of objection was received by the Division and will
be presented to the Mined Land Reclamation Board at the time of consideration
of the application
