There was some opposition to the permit, <br />but nothing was said that was serious. Nevertheless, because of the opposition, we respectfully request <br />that final approval of the Reclamation Permit be delayed until afrer the County Commissioners act on <br />the Conditional Use Permit. That consideration will probably occur on May 11 which is a few days <br />afrer the decision date for the Reclamation Permit. If the County Commissioners approve the <br />Conditional Use Permit then we can proceed with the Reclamation Permit. <br />I am not suggesting chat you stop the review of the application; only to delay the decision date until <br />after the County Commissioners act. It is likely that the Commissioners will approve the application, <br />but because this is an abandoned operation Castle does not wish to get into a situation where they are <br />required to reclaim the operation but are unable to operate it. <br />As some objections and comments have been presented to your office 1 am not sure if this means the <br />application must go before the MLRB. There is not much of substance in any of the objections, but <br />perhaps your policy is to take it to the board irrespective of the credibility of comments or objections. <br />If that is the case then I suggest the application be scheduled for the May MLRB meeting as that would <br />be afrer the County Commissioners have held their hearing. Of course, if the Commissioners deny the <br />Conditional Use Permit, Castle might withdraw the Reclamation Permit application, unless it is feh <br />chat further action at the county could overturn an unfavorable decision. <br />If you have any questions, please call. <br />Respectfu/lly, <br />~~~` ~~ <br />Mark A.
