At this
point, these questions are best handled by the applicant. This
matter has been referred to him, who should be responding to you
soon.
However, I should explain an important distinction at this point.
The Division treats "objections" more seriously than it does
"concerns." Your letter states that these items are "concerns."
The Division does not halt the permitting process over "concerns,"
but does of course try to resolve them.
On the other hand, when the Division receives an "objection," a
meeting will be called to bring all parties to the table. If the
matter is not successfully resolved by the designated mediator, the
permit may not be issued based on the originally-submitted
information.
Please send to us a statement specifying whether these points in
your letter are "concerns" or "objections" to the proposed clay
pit. If you have any questions, feel free to contact me.
Sincerely,
Bob Oswald
Reclamation Specialist
cc: Mr. Lloyd V.
