Long <br />Division Drrrcmr <br />The following letter is being written to address unresolved issues in 110 reclamation permit application for Permit rY <br />M-98-054, East Douglas Creek Gravel Pit. These issues must be clarified prior to your current application decision <br />due date of September 9, 1998, in order for the Division of Minerals and Geology (DMG) to be able to approve it. <br />1. On page 2, paragraph I of Exhibit C, Mining Plan it is stated that no impacts on groundwater are anticipated. <br />Will the Operator be mining above the water table, or will groundwater be exposed? if exposure of groundwater <br />is expected, the Operator must either have an approved substitute supply plan on record with the Office of the <br />State Engineer (OSE) or possess enough water rights to compensate for the evaporative loss of water. Please <br />specify which course of action is planned, or commit to remaining 2' above the water table. <br />2. On page 2, paragraph L of Exhibit C, Mining Plan, it is stated that the side slopes will no greater than 3H:1 V. Is <br />this the fmal grade, or will this be the working face of the mining excavation during operation? Please clarify. <br />3. What quantity of mulch will be spread per acre? The Division recommends 2 tons per acre, crimped in as <br />described in Exhibit D, the Reclamation Plan. Please commit to a specify quantity. <br />4. In accordance with Rule 6.3.12 of [he Construction Materials Rules and Regulations, [he written permission of <br />the owners of structures within 200' of the affected area must be obtained prior to excavation, or a detailed <br />engineering evaluation must be done to prove that excavation will have no effects on the structures in question. <br />A copy of an agreement with the structure owners or a geotechnical stability study must be submitted to the <br />Division. <br />Please submit the requested information as soon as possible, so we may complete the review of your application <br />prior to September 9.
