Sox 2329 <br />Denver, CO 80201 <br />' Re: 40 Acre Open Pit Clag ?.line, Section 27, <br />T1S, R70SV, Ibrothy Jenkins Lease <br />' Dear Mr. Spence <br />In order to assist the Denver Brick & Pipe Carrpany in obtaining a F~ermit <br />' from the Colorado t.iined Land reclamation Board, the Boulder County Zoning <br />Department formally recognizes the existence of a 40 acre open mining <br />operation authorized under land use permit n9315 on September 8, 1f56. <br />Certified tonnages of clay purchased from the Jenkins pit averaged 4,410 <br />_ tons per fiscal year from 1961 through 1978 with 1962, 1963 and 19E~5 <br />being years of abandonment. <br />~ ' Since the open mining special use amendment was effective on July E'~, 1976, <br />of continuous legal non-conforming use status has been maintained a2th <br />records of operation certified by George W. Stock Jr., Chief Accountant, for <br />' the Denver ffiick & Pipe Cor~any. <br />Any future expansion or enlargement of operations, however, beyond the <br />original 40 acres recognized for the 1966 use pewit shall be authorized <br />' only through the current Special Use Permit process.
