C. _. f..,.,O.,.CE., <br />TO: CHIPS BARRY, DIl2ECTOR, MINED LAND RECLAMATION DIVISION <br />FROM: HAL D, SIMPSON, CHIEF, WATER MANAGEMENT BRANCH <br />SUBJECT: TUCKER CONSTRUCTION COMPANY, WELD COUNTY, APPLICATION <br />FOR MINING AND RECLAMATION PERMTT <br />As requested by your office, we have reviewed the application for a gravel <br />operation near Carr on Lone Tree Creek. The following comments need to <br />be addressed prior to approval of the application: <br />1, The water resources portion of the report states that water <br />for the wash plant and fugitive dust control will be obtained <br />under a temporary transfer of rights owned by the Terry <br />Grazing Association. The rights amount to 10 cfs from the <br />Mantey Ditch. The Mantey Ditch water right is to be used <br />for irrigation purposes only until a change in use has been <br />obtained and until a plan for augmentation has been approved, <br />Therefore, a water supply for the mining operation is not <br />available, <br />2, The report states that the aquifer located 13 feet below the <br />mine floor should be more than adequate to supply the make up <br />water requirement. This water would be tributary ground water <br />and, therefore, cannot be used for any plan of augmentation <br />sine the Platte River Basin is over-appropriated and any well <br />would be subject to curtailment and would also require a plan <br />for augmentation in order to operate. <br />3. The plan would also invo'_ve the construction of a dam for a <br />4-acre wash water storage and a settling pond. It is not <br />clear whether the 31 acre-feet of consumptive use associated <br />with the gravel pit operation included evaporation from the <br />pond. <br />
