The following comments need to be addressed prior to approval of the application: 1, The water resources portion of the report states that water for the wash plant and fugitive dust control will be obtained under a temporary transfer of rights owned by the Terry Grazing Association. The rights amount to 10 cfs from the Mantey Ditch. The Mantey Ditch water right is to be used for irrigation purposes only until a change in use has been obtained and until a plan for augmentation has been approved, Therefore, a water supply for the mining operation is not available, 2, The report states that the aquifer located 13 feet below the mine floor should be more than adequate to supply the make up water requirement. This water would be tributary ground water and, therefore, cannot be used for any plan of augmentation sine the Platte River Basin is over-appropriated and any well would be subject to curtailment and would also require a plan for augmentation in order to operate. 3. The plan would also invo'_ve the construction of a dam for a 4-acre wash water storage and a settling pond. It is not clear whether the 31 acre-feet of consumptive use associated with the gravel pit operation included evaporation from the pond.
