r- .~~-~ <br />.a <br />Received <br />MAR 0 7 2006 <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures ~ <br />rand Junction Field Offic6~ <br />Division of Minerals & Geolo®v <br />The mining operation will not adversely affect the stability of any significant, valuable or <br />permanent man-made structures located within two hundred (200) feet of the affected <br />land. <br />The permanent man-made structures located within or adjacent to a line drawn two <br />hundred (200) feet from the affected land are: <br />A fence and gate, owned by the Applicant, located along the township line. <br />A private road owned by the Applicant. <br />These structures are depicted on the mining plan map. <br />Mining cannot be performed within 200-feet of a structure unless an engineering <br />evaluation is made that demonstrates the structures will not be damaged by the <br />proposed operation. <br />There will not be any excavation associated with the pit access road. Therefore, there <br />will not be an excavation to undercut or create an unstable cut slope where the pit <br />access road intersects the private road to the north. <br />The fence and gate are located within about 150 feet of the pit boundary. A 20 foot <br />deep vertical excavation would leave an effective slope between the pit and the fence of <br />7.5H:1 V. The angle of repose of weathered shale is steeper than 3H:1 V so the fence <br />cannot be damaged by the pit excavation. <br />I, J. E. Stover, P.E., have a wide variety of experience in design and construction <br />activities including evaluation of the stability of cut and fill slopes which are applicable to <br />gravel pit activities. <br />Based upon my evaluation of the proposed operation, it is my professional opinion the <br />structures adjacent to the pit access road will not be damaged bXohe operation because <br />there will not be an excavation to create an unstable slope ~~i~erSL~'g/._fence, gate or <br />private road. <br />James E <br />P.E.
