r
•
Mr. Mark A. Heffner - 4 - October 23, 1991
Item No. B
The operator indicated that the inspection date was September 19, 1991;
and that the report was markea on October 5, 1991. As the operator
clearly indicated under Rule 8.1(5)<c> the inspection report should be
mailed or filed at Mined Land Reclamation Division, the mine office or
other suitable location within 10 days of the date of the inspection. He
also stated that the "Division follow this Rule and possibly develop a
new procedure for preparing and sending out inspection reports.
When problems are noted in the inspection report, there are often
deadlines that must be met to avoid violation. The Division agrees with
your comments however, as you are well informed while working at Mined
Land Reclamation Division and as a consu]tant, the Division has never
rejected a request from an operator for an extension of deadlines that
must be met to avoid violations. The Division has always granted
reasonable extensions to meet the required corrective action.
Item No. 9
The inspector properly reported what he observed. At the time of the
inspection all topsoil piles observed were found to be eroding and this
problem was also mentioned to the operator present at the time.
If you require additional clarification, please contact the Division.
Sincerely,
Berhan Keffeiew
Reclamation Specialist
BK/ern
CC: Mr. Carl C. Herskind
Daniel Hernandez. MLRD
6892E
