Said Monitoring Plan will be submitted to and approved by the Office of the State <br />Engineer. If determined by OSE to be necessary, the Monitoring Plan will include a <br />commitment to monitor adjacent wells (where allowed by an adjacent well owner) and/or <br />install new monitoring wells. Said Monitoring Plan would include proposed measures to be <br />undertaken, in the event data from existing wells (where monitoring is allowed) and new <br />monitoring wells in accordance with standards in the Monitoring Plan approved by OSE, <br />determines that the operation is having any demonstrated adverse affect on adjacent wells or <br />basements. It is unknown how many ofthe identified wells are still in operation today .Some <br />of the wells are large capacity irrigation wells with the majority being small capacity wells. <br />It is unknown if any of the wells provide domestic water to the owner, however, given the <br />poor water quality in the area, it is unlikely that water from this aquifer serves as a potable <br />supply. Subject to approval by OSE, the operator proposes to monitor the groundwater table <br />as follows: <br />A monitoring grid will be located around the property. A total of 6 monitoring points <br />will be established with baseline data collected prior to the start of mining. The <br />baseline information will consist of at least three sets of water table measurements <br />being made before mining starts. The measurements will attempt to collect data <br />during different times ofthe year to allow for fluctuations that normally occurs, such <br />as deep water percolation for irrigation, etc. <br />The operator will monitor the water table on a monthly basis for the life of the mine. <br />The water table data shall be supplied to the Division of Minerals and Geology <br />(DMG) with the annual report. <br />In response to concerns of Mrs. Bromley and K.T. Barr, Inc. are the owners of wells <br />and lakes to the north of the permit area, CAMAS entered into an indemnification <br />agreement for mitigation in the event of adverse impact to historic use these wells and <br />lakes, unless CAMAS can present substantial, credible evidence that CAMAS's <br />mining operation is not the cause of any adverse impacts. A copy of the <br />Indemnification Agreement is included as pages 13 - 17 as part of this Exhibit. The <br />DMG also required a stipulation on the same matter that was made a condition of the <br />permit (DMG S#2). <br /> <br />
