Mount <br />July 21, 2003 <br />Page 7 of 10 <br />Rule 6:4.7 EXHIBIT G -Water Information, sets forth additional criteria and <br />application submittal requirements governing the surface and ground wafter <br />implications of this application. <br />The applicant has represented that it does not expect to directly affect <br />surface or groundwater systems. The applicant is wrong on both counts. <br />Specifically, as discussed above, surface drainage will be interrupted by the <br />proposed 150+ acres of pit and operations. Further, as also discussed at <br />length above, this operation is expected to encounter groundwater <br />periodically for significant portions of the year. Accordingly, the application <br />must •be amended to provide all information and data required at Rule <br />6.4.7(2f. <br />Further, review of this application is complicated if not made impossible by <br />the applicant's failure to satisfy the application submittal requirements of <br />Rule 6.4.7(3), 14) and 15). The application must be amended to include all <br />required data and information prior to proceeding with agency and public <br />review. <br />Reclamation <br />The permit application documents placed on file with the Montrose County <br />Clerk reflect a proposed post mining land use of 'rangeland'. Further, all <br />reclamation discussion in the application, limited though it may be, reflects a <br />'rangeland' post mining land use. We are informed that the applicant wishes <br />to amend his post mining land use to 'cropland'. The following comments <br />recognize that desire, but the MLRB should be aware, as of the date of these <br />comments, the application deposited in Montrose County is substantially <br />inaccurate: <br />The critical term 'Reclamation' is defined as: <br />.:. the employment during and after a mining operation of <br />procedures reasonably designed to minimize as much as <br />practicable the disruption from the mining operation and to <br />provide for the establishment of plant cover, stabilization of soil, <br />the protection of water resources, or other measures <br />appropriate to the subsequent beneficial use of such affected <br />lands.... <br />~joos <br />See Rule 1.1 (41) <br />
